H-1B Visa Latest Rules for Indian Professionals in the USA (2026 Update)

Introduction

The H-1B visa remains the most important work visa for Indian professionals seeking to work in the United States. In 2026, major reforms were introduced to how H-1B visas are selected and processed.

What’s Changed in 2026?

1. No More Random Lottery

Previously, H-1B slots were allotted through a random lottery. This is being replaced by a weighted selection process, where applicants with higher wages and stronger skills get preference.

What this means:
• Higher salary offers from employers → better chance of selection
• Entry-level offers → relatively lower odds

2. New Employer Fee

A one-time $100,000 fee is now required for new H-1B petitions filed from outside the U.S. after September 21, 2025. The Indian Express
